The service is aimed at citizens who have a direct and current interest corresponding to a legally protected situation and linked to the document to which access is requested.

Description

The right of access to documents is the right to inspect or extract copies of administrative documents by persons, including public or disseminated stakeholders, who have a direct, concrete and current interest, corresponding to a legally protected situation and linked to the document to which access is requested, as governed by Chapter Five of Law No 241 of 7 August 1990, new rules on administrative procedure and the right of access to administrative documents.

How to do

You can make the request directly online. It will then be possible to follow the progress of the request in your personal area.

What you need

To access the service, make sure you have:

  • SPID (Public System for Digital Identity Management), Electronic Identity Card (CIE);
  • receipt of payment of secretarial fees;
  • n.1 stamp from € 16,00 in case of request for a certified copy

What you get

By sending the request you can receive, at the end of the investigation, the documents requested digitally or an appointment to view them at the counter.

Timing and deadlines

Within 30 days, the Body shall send the documentation in the manner provided for in the request; if the consultation or collection takes place in person at the counter, it will be the responsibility of the Body to communicate the headquarters and the time of the office to which to turn. In the event that access to the requested act is denied or deferred, the citizen may within 30 days lodge an appeal with the Regional Administrative Court (TAR) or request, within the same period, the regional ombudsman competent for the territorial area that the aforementioned determination be reviewed pursuant to Article 25 paragraph 4 of Law 241/90.

How much does it cost

Access to documents is subject to the payment of secretarial fees via pagoPA. The issue of copies is subject to the payment of reproduction costs, the rates of which are established by the Municipal Regulations. In the case of a request for access to administrative documents in a certified copy, both the request and the documents are subject to stamp duty. For copies conforming to the original, a EUR 16.00 stamp must be affixed to the application.
